Terms and Conditions

  1. General
    1.             These Terms and Conditions set out the terms of use on which you make use of the Website and Services (as defined below).  By using or accessing the Website and Services, you indicate that you have read, understood and accept these Terms and Conditions, together with our Privacy Policy (the latest version of which is available at www.greenticket.com.au ), and that you agree to abide by them. If you do not agree to these Terms and Conditions, you must refrain from using the Website and Services.
    2.             In these Terms and Conditions:

(i)                   “Fee” means the applicable amount payable to Green Ticket for a particular Service;

(ii)                 “Intellectual Property” means all present and future intellectual or industrial property rights anywhere in the world, including without limitation any copyright, moral right, patent, trade mark, registered design, registered or unregistered plant breeder’s right, trade secret, knowhow, right in relation to semi-conductors and circuit layouts, trade or business or company name, indication or source or appellation of origin or other proprietary right or right of registration of such rights;

(iii)                “Services” means the environmental management awareness training services and/or courses that are to be provided by Green Ticket from time to time;

(iv)                "we", "us" or "Green Ticket" means GreenTicket Pty Ltd ACN 620 513 135, a proprietary limited company incorporated in Queensland, Australia and its associated entities as appropriate; and

(v)                 “Website” means http://www.greenticket.com.au/ or any other website from time to time from which the Services are promoted and/or delivered;

  1. Fees
    1.             A user of the Services will pay Green Ticket the Fee in consideration for Green Ticket providing the corresponding Service.
    2.             Green Ticket may refuse to provide you with any relevant certifications of completion in respect of a Service until the Fee for that Service is received by Green Ticket in full. 
    3.             The current Fees at any given time for a particular Service will be available on the Website.  All Fees will be subject to change from time to time, as notified to the email address linked to your user account and on the Website, however any changes will only apply from the future date set out in our notice to you.
    4.             All Fees are expressed in Australian dollars. The Fees may be subject to foreign exchange fees and differences based on prevailing exchange rate if you choose to pay them via a credit card or account using foreign currency.
    5.             You agree to indemnify us in respect of any fees that we are charged as a result of your payments being dishonoured, rejected or recovered from us.  You acknowledge that we may seek reimbursement of such expenses.
  2. Payments
    1.             No credit card or payment information is entered or stored on the Website.  All payments are securely handled by certified third party payment gateways, and the full details of any credit cards utilised for payments will never be available to us.  However, this means that we have limited control over the payment gateways.
    2.             You will be sent a receipt for your payment promptly after the payment gateway confirms to us that your payment has completed successfully.
  3. Disclaimer and Liability
    1.             In providing the Services and providing information and advice on its Website and through its Services, Green Ticket:

(i)                   uses its best endeavours to ensure that the Services and the information and advice provided on its Website and through its Services are up to date, accurate and considered, including in respect of any environmental regulatory requirements; and

(ii)                 provides a general overview of relevant state, national and (where appropriate) international environmental regulations and obligations.  Your specific company, site or project may have particular requirements under local legislation and regulations, project contracts and site environmental management plans.  Green Ticket does not provide specific advice or recommendations on how best to comply with your specific company, site or project specific environmental requirements.

4.2                Given the above, Green Ticket:

(i)                   cannot guarantee that every change will be instantly reflected in the Website and Services, or that the information and advice provided on the Website and through its Services will remain current as future changes in the environmental regulatory framework occur;

(ii)                 advises all persons who use its Website and Services to refer to their company environmental compliance and management teams (or other qualified persons) and guidance for specific advice in environmental matters, which should be based on a review of all specific regulatory requirements, site environmental management plans, project contracts and any other applicable requirements.

4.3                To the maximum extent permitted by law, Green Ticket, its directors, officers, employees, contractors and agents will not be liable to you for any claim arising out of or in any way connected with your use of the Website and/or Services for any direct, indirect, special or consequential loss, loss of profit, loss of income, loss of business or loss of opportunity, howsoever arising and whether caused by breach of statute, breach of contract, negligence or any other tort.

4.4                If any guarantee or warranty under the Competition and Consumer Act 2010 (Cth) or comparable state or territory legislation cannot be excluded, you agree that our liability is limited, to the extent permitted by law, to the re-supply of the relevant Services, or the payment of an amount equal to the cost paid for those Services, during the period in which the Services were provided in breach of the relevant guarantee or warranty.

4.5                Without limiting clause 4, you agree that in no event shall the maximum aggregate liability of Green Ticket, its directors, officers, employees, contractors and agents exceed either a refund of the relevant Services. 

  1. Refund Policy
    1.             The following policy applies for all cancellation and change of course requests:

(i)                   all cancellation requests or requests to change courses must be received in writing (Notice of Cancellation/Transfer);

(ii)                 the date of a Notice of Cancellation/Transfer is date it is received by Green Ticket;

(iii)                if the Notice of Cancellation/Transfer is received by Green Ticket:

(A)                prior to a particular Service having commenced, Green Ticket will provide you with a credit that you may use to acquire another Service form Green Ticket; or

(B)                 after a particular Service has commenced, there will be no refund of any Fees paid for that particular Service and you will not be able to transfer to another Service;

5.2                Despite the above and upon application to Green Ticket, Green Ticket, in its absolute discretion, may decide to refund (in part or in full) a Fee for a particular Service or allow a transfer from one particular Service to another Service in cases of extreme hardship or extenuating circumstances.   Submitting an application does not guarantee a full or partial refund or a transfer.

5.3                To avoid any doubt, the limitations of liability outlined at clause 4 apply to this clause 5.

  1. Access and registration
    1.             Green Ticket will use its best endeavours to ensure that access to the Services is available at all times.  However, we will not be liable if for any reason the Services are unavailable at any time or for any period.
    2.             From time to time, we may restrict access to some or all of the Services as required for ongoing development and maintenance.  We will endeavour to provide you with reasonable notice of such down time, but you acknowledge and agree that this will not always be possible.
    3.             You warrant that any information that you provide during the registration process is true and accurate.
    4.             We reserve the right to immediately suspend or disable your access to the Services if, in our reasonable opinion, you have failed to comply with any of the provisions of the Terms and Conditions.
  2. Log-in information
    1.             You agree that your account and registration are provided to you personally and must only be accessed by you. If you are provided with log-in details or a password or any other piece of information as part of our security procedures (“log-in information”), you must treat such information as confidential and keep it secure, and you must not:

(i)                   disclose it to any third party;

(ii)                 allow or enable a third party to freely access the Website or the Services via your log-in information; and

(iii)                store the log-in information in such a manner that it could be copied, utilised or distributed by any virus, software or third party.

7.2                If you are aware of any unauthorised access of the Website or the Services with your log-in information, or if you become aware that your log-in information has become known to a third party, you must immediately notify us.

  1. Intellectual Property
    1.             You acknowledge that all Intellectual Property in respect of the Services anywhere in the world belongs to Green Ticket and that you have no rights in, or to, Intellectual Property in respect of the Services other than the right to use them for the purpose of undertaking the Services.
  2. Termination
    1.             This agreement may be terminated by you or us at any time without notice.  Upon termination, you will no longer have any right to use or access the Services.
    2.             Except where this agreement is terminated for breach of these Terms and Conditions, if Green Ticket terminates this agreement, you will be entitled to a full refund in respect of any Services which you have paid for but which you have not been able to complete by reason of Green Ticket’s termination.
    3.             For the avoidance of doubt, if you terminate this agreement, you will not be entitled to any refund except in accordance with the Refund Policy outlined at clause 5.
    4.             Clauses 2, 4, 8, 9 and 10 shall survive termination.
  3. Other
    1.          We may change these Terms and Conditions at any time without prior notification to you.  You agree that if we do so, those changes will come into effect the next time you use the Website and Services after receiving notification of the changes to the Terms and Conditions.  Your continued use of the Website and Services will constitute acceptance of the updated Terms and Conditions. The latest version of these Terms and Conditions will always be available at www.greenticket.com.au .
    2.          If any provision of these Terms and Conditions is found by any court or body of competent jurisdiction to be wholly or partially illegal, invalid, void, voidable, unenforceable or unreasonable, it shall be deemed severable to the extent that the remaining provisions of these Terms and Conditions shall continue in full force and effect.
    3.          By using the Website and Services, you acknowledge and agree to be bound by these Terms and Conditions and the Privacy Policy (the latest version of which is available at www.greenticket.com.au).
    4.          Queensland law governs these Terms and Conditions.  Each party irrevocably submits to the non-exclusive jurisdiction of the Queensland courts and courts competent to hear appeals from those courts.

Privacy Policy

  1. General
    1.             This Privacy Policy applies to all Personal Information collected by GreenTicket Pty Ltd (Green Ticket).  Green Ticket is committed to complying with its obligations under the Privacy Act 1988 (Act) and the Australian Privacy Principles (APP) in respect of that information.  In this policy, we explain how and why we collect your information, how we use it, and what controls you have over our use of it.
    2.             In this Privacy Policy:

(i)                   “OAIC” means the Office of the Australian Information Commissioner;

(ii)                 “Personal Information” has the meaning given to that term in the Act;

(iii)                “Sensitive Information” has the meaning given to that term in the Act;

(iv)                “Services” means the environmental management training services and/or courses that are to be provided by Green Ticket from time to time;

(v)                 “we”, “us” or “Green Ticket” means GreenTicket Pty Ltd ACN 620 513 135, a proprietary limited company incorporated in Queensland, Australia and its associated entities as appropriate;

(vi)                “Website” means http://www.greenticket.com.au/ or any other website from time to time from which the Services are promoted and/or delivered; and

(vii)              “you” means you and anyone acting on your behalf or with your implied authority.

1.3                Please read this Privacy Policy carefully.   Your use of any part of our Website or Services will constitute your consent to the collection, transfer, processing, storage, disclosure and other uses of your Personal Information in accordance with this Privacy Policy.  If you do not agree with the terms and conditions of this Privacy Policy, please do not use our Website or Services.

  1. Types of Personal Information we collect
    1.             We collect and hold various types of Personal Information, including:

(i)                   personal details, including name, contact details and date of birth;

(ii)                 contact details, including your email address, address and phone number;

(iii)                employment details;

(iv)                Sensitive Information;

(v)                 financial information, including ABN/ACN, banking details, billing and payment details;

(vi)                information directly related to your use of the Services, such as your results, your progress and your completion status of the Services;

(vii)              information obtained by cookies and other technological tools to collect information about your computer and your use of our Website and Services.  We treat this information as Personal Information when it is associated with other Personal Information from which you can be identified.  For more information about cookies and other technologies, please see the section Cookies below; and

(viii)            where you work for us or apply to work for us:

(A)                family contact information;

(B)                 information about you included in your employment application or resume, including your education, qualifications and employment history; and

(C)                any other employment related information.

2.2                We may also retain and utilise de-identified information (which will not contain your name or other information that would identify you) to for the purposes of developing, managing and marketing our Website and Services, and may provide such de-identified information to third parties, unless you have specifically requested that this not occur.

  1. How we collect Personal Information
    1.             We may collect Personal Information from you when:

(i)                   you access or use our Website or Services;

(ii)                 you contact us or communicate with us, our employees or our representatives;

(iii)                you deal with us in the course of business;

(iv)                we solicit it from third parties in the course of our business; and

(v)                 it is provided from publicly available records or public registries that we accessed in the course of our business.

3.2                Where we solicit Personal Information, we only collect:

(i)                   non-Sensitive Information, if it is reasonably necessary for the services we provide; and

(ii)                 Sensitive Information, if it is reasonably necessary for or directly related to services we provide and you have consented to its collection, or its collection is permitted or authorised by law.

3.3                If we solicit Personal Information, we will generally solicit it directly from you, unless it is unreasonable or impracticable for us to do so.  Where we collect Personal Information about you from a third party without your prior consent, we will take reasonable steps to inform you that we have collected personal information.

  1. Storage and protection of information
    1.             We prioritise the security of your Personal Information whilst it is in our possession. 
    2.             We may hold Personal Information in physical documents or in electronic form.  Physical files are kept securely inside our access controlled premises.  Electronic files are only accessible through our secure network.
    3.             We take reasonable steps to:

(i)                   ensure that Personal Information we collect is accurate, up-to-date, complete and relevant, other than where it is only collected to provide advice in respect of a particular point in time, in which case we will seek to ensure it is accurate, complete and relevant as at that particular point in time;

(ii)                 ensure that Personal Information we use or disclose is accurate, up-to-date, complete and relevant, having regard to the purposes for which Personal Information is used or disclosed;

(iii)                protect Personal Information from misuse, interference and loss, and from unauthorised access, modification or disclosure; and

(iv)                destroy or de-identify Personal Information which we no longer need for the purposes for which it was collected, except where it is necessary to retain it in order to maintain ongoing records for our clients.

4.4                We cannot guarantee the security of information transmitted via the internet.  As such, transmission of Personal Information via the internet is at your own risk and we cannot be held responsible for the security of such information.

  1. Use and disclosure of Personal Information
    1.             We retain the right to use or disclose Personal Information about you:

(i)                   for the purpose(s) for which it was disclosed to or collected by us;

(ii)                 for secondary purposes where it would be reasonable to expect us to do so, and that secondary purpose is related (or directly related in the case of Sensitive Information) to the primary purpose for which it was collected;

(iii)                for any other purposes for which you have consented from time to time.

5.2                The above purposes include using and disclosing your Personal Information: 

(i)                   to supply the Services or other products to you or facilitating other interactions with you in the course of operating our business;

(ii)                 to share your Personal Information to employees and representatives of Green Ticket to assist us with providing the Services; 

(iii)                to professional advisors and contracted service providers engaged by us to assist in providing our Website and Services (e.g. lawyers, accountants, consultants and insurers);

(iv)                to third parties who assist us with developing, marketing and managing our business, including in respect of our Website and Services;

(v)                 to respond to your enquiries and provide you with relevant information;

(vi)                to process authorised payments;

(vii)              to update your Personal Information;

(viii)            to collect information required for reporting to relevant regulatory bodies;

(ix)                to develop, manage, promote and market our Website and Services;

(x)                 as permitted or required by law; and

(xi)                for any other uses identified at the time of collecting your Personal Information.

5.3                We may disclose your Personal Information to such persons as is necessary to achieve the above purposes.  This will often include disclosure to our related bodies corporate, contractors or other third party service providers.

5.4                If we engage third party contractors to perform services for us which involves handling Personal Information, we take reasonable steps to prohibit the contractor from using Personal Information except for the purposes for which it was supplied.

  1. Testimonials and user feedback
    1.             We sometimes receive testimonials and comments (Content) from users who have had positive experiences with our Website and Services.   We occasionally publish such Content.  When we publish this Content, we may identify our users by their first and last name and may also indicate their home city.  We will obtain the user’s consent prior to posting their name along with their testimonial.
  2. Direct marketing
    1.             We may send you direct marketing communications and information about our business and services that we consider may be of interest to you.  These communications may be sent via mail, email and through social media platforms.  At any time you may opt-out of receiving marketing communications from us by contacting us at the details below or by using opt-out facilities provided in our communications.  We do not provide your Personal Information to other organisations for the purposes of their direct marketing.
  3. Overseas disclosure
    1.             It is unlikely that we will need to disclose your Personal Information to an overseas recipient or otherwise store your Personal Information overseas.
    2.             If we are ever required to do so, we will obtain your informed consent or ensure that the overseas recipients comply with the APPs.
    3.             As noted above, we may provide de-identified information for the purposes of developing our Website and Services or marketing our Service to third parties, unless you have specifically requested that this not occur.  Those third parties may potentially store and disclose that information to overseas recipients.
  4. Use of Cookies
    1.             To improve your experience on our website, we may use ‘cookies’: small data files that are served by our platform and stored on your device.  These are used by us or third parties for a variety of purposes including to operate and personalise the website.  Cookies may be used for recording preferences, conducting internal analytics, conducting research to improve our offering, assisting with marketing and delivering certain website functionality.
    2.             You may refuse to accept cookies by selecting the appropriate setting on your internet browser.  However, please note that if you do this, you may not be able to use the full functionality of our website.
  5. Third parties
    1.          For your convenience and to improve the usage of the Website and Services we may insert links to third-party websites, applications or resources, for which this Privacy Policy does not apply. 
    2.          Green Ticket is not responsible for those third party websites, applications or resources.  If you access such websites, applications or resources, you do so at your own risk and we make no representations or warranties regarding third parties’ privacy practices.  We encourage you to read the privacy statements/policies of every website, application or resource you use.
    3.          When we do link to a third party website, application or resource, this does not automatically imply that Green Ticket endorses that website, application, resource and their contents.
    4.          Our Privacy Policy does not cover the use of cookies by any third parties. 
  6. Access to and correction of Personal Information
    1.          We are committed to maintaining accurate, timely, relevant and appropriate information.
    2.          Where requested, we will provide you with a copy of the Personal Information that we hold which relates to you, provided that the request is made in accordance with the APPs (contained in the Act).  We will also update any inaccurate information about you if you inform us that the information is inaccurate, out of date, incomplete, irrelevant or misleading. 
    3.          There are no charges for requesting access to or the correction of your Personal Information, however if the volume of information we hold is excessively large, we reserve our rights to charge you any reasonable administration fees (including fees for photocopying) associated with your request.

11.5            We will respond to those requests within a reasonable period in accordance with our obligations under the Act.  If we refuse a request to access or correct Personal Information, where reasonable, we will provide you our reasons for doing so and information about your ability to complain about such refusal.

11.6            In order to protect the confidentiality of your Personal Information, details of your information will only ever be passed on to you where we are satisfied that the information relates to you.   Accordingly, we may request documentation from you which confirms your identity before passing on any Personal Information which relates to you.

    1.          If you have a complaint about our Privacy Policy or the collection, use, disposal or destruction of your Personal Information, your complaint should be directed in the first instance to our privacy officer at the details set out above.
    2.          We will investigate your complaint and attempt to resolve any breach that might have occurred in relation to the collection, use or destruction of Personal Information held by us about you in accordance with the Act.  If you are not satisfied with the outcome of this process, then you may contact the OAIC.
  2. Privacy Policy changes
    1.          We may change this Privacy Policy at our discretion.   If we do so, the latest version of our privacy policy will be available on our Website at, and it will apply to all your Personal Information held by us at that time. www.greenticket.com.au .
